On the 27th, the Real Estate Distribution Promotion Center published the 2024 Research Report titled "Notes on Commercial Real Estate Transactions Learned from Judicial Precedents."
In commercial real estate transactions, there can be grounds for non-conformity with the contract, such as violations of the Fire Service Act or cases where the building is an existing ineligible structure. Disputes often arise later. To prevent such disputes, we have compiled a list of precautions based on judicial precedents related to past disputes.
For each of the 52 judicial precedents related to sales and lease contracts for commercial real estate, we have identified items that can be checked to prevent disputes in advance. These items are organized into a checklist from the perspectives of (1) documents to be confirmed, (2) items to be confirmed, and (3) precautions to be taken. Additionally, the report includes columns useful for preventing disputes and summaries of court precedents.
